Terms of service

The plain-language rules for hosting a site on sap13ns.site, for free personal sites and paid commercial plans.

These terms apply to the hosting service offered on sap13ns.site by BAUBER.XYZ SL (CIF B93944700, Rambla Poblenou 38, 08005 Barcelona, Spain; victor@bauber.xyz), "we" in this text. They do not apply to the sap13ns software itself, which you can use under its open-source licence without accepting anything here.

We have tried to write them so that you can read them in a few minutes. If something is unclear, ask us.

1. Who can sign up

You must be at least 16 years old, or the age of digital consent in your country if higher, and able to enter into a contract. If you sign up for a company, you confirm that you may act on its behalf.

2. Your account

Give us accurate information and keep it up to date. Keep your password safe and use two-factor authentication; you are responsible for what happens under your account. Tell us straight away if you think someone else has accessed it.

3. Acceptable use

You are responsible for the content you publish. You may not use the service to:

  • publish anything illegal, or content that incites violence or hatred;
  • infringe copyright, trademarks or other rights of others;
  • distribute malware, run phishing pages or deceive visitors;
  • send spam or host content whose purpose is to promote spam;
  • attack, probe or overload our systems or anyone else's;
  • try to get around the limits of your plan or the security of the platform;
  • harass people or publish their personal data without a legal basis.

We may remove content or suspend a site that breaks these rules. Where possible we will tell you first and give you a chance to fix the problem; in serious or urgent cases we may act immediately.

4. Free personal sites

Personal sites are free for non-commercial use: no selling, no advertising, no paid services and no promotion of a business.

Every new personal site is reviewed by a person before it is published. We may refuse a site without having to give detailed reasons, and we may later suspend a personal site, or ask you to move it to a commercial plan, if it is used commercially. Free sites have the limits shown at signup, and we may change those limits with reasonable notice.

5. Commercial plans and payment

Commercial plans are paid in advance, monthly or yearly, as you choose at checkout. If a free trial is offered, checkout shows how long it lasts; a trial is only for an account's first subscription, and the first charge is made when it ends. Payments are processed by Stripe; by paying you also accept Stripe's terms for payment services. Prices are those shown at checkout when you subscribe, and the invoice states the taxes that apply.

If we change the price of a plan, we will tell you by e-mail at least 30 days before it applies to you. If you do not agree, you can cancel before the change takes effect.

If a renewal payment fails, we will let you know and try again, and your site stays online for 14 days. If it has still not been paid by then, the site is held: its public pages show a notice that it is paused and unavailable, while you can still sign in to it, pay and export your content. Paying, or subscribing again, lifts the hold.

6. Cancellation

You can cancel at any time from your account. The cancellation takes effect at the end of the period you have already paid for; until then your site stays online. After that the site is held, as described in section 5, and section 7 explains how long we keep it. We do not refund partial periods, except where the law requires it. To close your account altogether, write to us.

If you are a consumer in the European Union, you have a 14-day right of withdrawal from the contract. By asking us to start the service immediately you accept that, if you withdraw, you pay for the service provided up to that point.

7. Your data and your content

Your content remains yours. You give us only the permission we need to host and display it.

You can export your content at any time while your site exists, from Export in its administration: a WordPress-compatible file (WXR), or a .zip with that file, your media and a Markdown copy of every post and page. This also works while the site is held. If we have suspended your site, ask us and we will export it for you. Once a site has been deleted, it can no longer be exported.

When your plan ends or your account is closed, your site is not deleted straight away: we keep it, with its content, files and domains, for 90 days, so you can still export it or subscribe again. After that our team deletes it, and it also disappears from our backups as they rotate out. Personal data is handled as described in the privacy policy.

Our team signs in to your site's administration only with your permission: you grant support access from your site, for a limited time. Each of these sign-ins is recorded in your site's audit log. The only exception is a legal order or a serious security incident on your site, such as malware or phishing: then our team may open your administration for at most four hours, with the reason recorded in your site's audit log, and we e-mail you at once with who did it, why and until when.

8. Suspension and termination by us

We may suspend or close an account that seriously or repeatedly breaks these terms, that does not pay, or when the law or an authority requires it. Except in urgent cases we will warn you first. If we decide to stop the service altogether, we will give you at least 60 days' notice so you can move your sites.

9. Availability

We work to keep the service running, secure and backed up, but we do not guarantee uninterrupted availability. Maintenance, updates and incidents may cause interruptions; we try to schedule planned work at quiet times. There is no service level agreement unless we have agreed one with you in writing.

Keep your own copy of anything you cannot afford to lose; you can export your site at any time while it exists (see section 7).

10. Liability

We are liable for damage caused by our intent or gross negligence, and as the law requires. Otherwise, to the extent permitted by law, our liability is limited to the amount you paid us in the 12 months before the event, and we are not liable for indirect damage such as lost profits or lost data you could have restored from your own copies.

None of this limits the rights you have as a consumer under the law.

11. Changes to these terms

We may update these terms when the service or the law changes. We will tell customers about important changes by e-mail at least 30 days in advance. If you do not agree, you can cancel before they take effect.

12. Applicable law

These terms are governed by Spanish law. Disputes will be resolved by the courts that are competent under the applicable rules; if you are a consumer, you can always go to the courts of your place of residence.
